Lawyers have a multi-faceted reputation – not all of it flattering, but being the “stick in the mud” when it comes to fulfilling your contract when you buy or sell a home is something I will happily claim.

It is my job as your lawyer to be on the lookout for ways to protect you throughout the buying and selling process.  We review your contracts, your mortgage documents, the title for your property, and any receipts and repairs required by the contract.

Review the Details in the Purchase/Sale Contract

In contracts, I make sure everything is signed. I make sure you are aware of any risky clauses that may be included so I can be sure that you are fully aware of the meaning of those clauses before you firm up/waive your conditions on a contract to buy a home. If I find an issue, I will insist on its correction on your behalf.

Review the Title to a Property

For the title to a property you want to buy in Nova Scotia, I will provide you with a copy of things like restrictive covenants or easements that you may not have seen before. I also ensuring that if you have private access it is properly registered at the Nova Scotia Registry of Deeds. I make sure you are getting clear title to your property (i.e. no liens). If I find problems, I will help you either get them sorted out, or help you decide if perhaps it’s not the right property for you.

Ensure Receipts are Filed and Repairs done Properly

For receipts and repairs I ensure things like the septic pump and oil receipts for closing are recent. I confirm that repairs are done by professionals when required. (Sellers sometimes try to save money by doing repairs themselves, which is usually not ideal.)If we don’t get the receipts required – I will negotiate credits or holdback funds on closing to make sure you are not paying out of pocket in addition to paying the seller for any adjustments or repairs.

I will insist on all of these things, in order to make sure you are really getting what you agreed to when you are buying or selling your home, and if someone doesn’t like it blame your lawyer – that’s what we’re here for.
