Purchase

We can help with the purchase of your new home. Your real estate agent will send us the Purchase and Sale Agreement. We then review the agreement and raise any issues that may jeopardize your deal. We draft your mortgage documents, and meet with you to explain and sign them. We handle the exchange of money for the transaction, as well as the registration of your deed and mortgage with the registry of deeds.  If there are any issues along the way, we will negotiate on your behalf.

Our legal fee for a standard property purchase is $950.00+HST, plus disbursements. We offer a discount to people doing both a sale and purchase with us.

sale

We can help with the sale of your property. Your real estate agent will send us the Purchase and Sale Agreement. We then review the agreement and raise any issues that may jeopardize your deal. We draft deed to sell the property, and meet with you to explain and execute (formally sign) it. We handle the exchange of funds for the transaction. Once the transaction is completed we will pay out any mortgages with the proceeds of the sale, and discharge the mortgage from the title of the property. If there are any issues along the way, we will negotiate on your behalf.

Our legal fee for a standard sale is $850.00+HST,  plus disbursements. We offer a discount to people doing both a sale and purchase with us.

migration

A migration is converting the title records of your property from the old paper system to the 'new' electronic registry of deeds. This can be done on a voluntary basis, but is required when you sell, subdivide or refinance your property in almost all cases today. We sort out any outstanding easement or title issues, then draft the required documents and meet with you to review and execute (sign) them.

Our legal fee for a standard migration is $1100.00+HST, plus disbursements.


MORTGAGE REFINANCE 

If you are planning to refinance your current mortgage, we can assist you with the legal aspects of this process. We will draft your new mortgage, and explain your obligations under the new mortgage when we meet with you to sign the documents. We  ensure that the new mortgage is registered to the property, and the old mortgage is discharged. Often in a mortgage refinance we will also take care of paying out other debts that are effectively be consolidated under the new mortgage.

Our legal fee for a standard refinance with a traditional bank is $725.00+HST, plus disbursements.

right of ways

If your driveway crosses someone else's property, or your well sits on another lot that does not belong to you, you will likely need to get an easement to ensure your rights to use it are protected. Conversely you may want to grant an easement to a neighbour for access or maintenance of their property. An easement is a right to go onto or use a portion of a lot for a specific purpose. Common examples are well easements, rights of way for a driveway. We can help you sort out your right of way or easement issue.  

If both parties are in agreement, we can create an easement at a flat rate, if negotiation is required we will work at an hourly rate. 

quit claim deed

If you are transferring the title to your property, but not by way of a traditional sale. This process is typically done by way of a Quit Claim Deed, where you 'quit' your sole title to the land to someone else. People often transfer title this way during a separation or divorce, when transferring title to land to another family member, or adding a new partner to the title to a home. Quit claim deeds are often done in conjunction with a mortgage re-finance, when a party is required to be added or removed from title.

Our legal fee for a standard Quit Claim Deed is $400.00+HST, plus disbursements.


DISPUTES

If you are having an issue with a neighbour or if someone is objecting to your title to your property we are happy to help you sort out this situation. We offer a flat fee consultation service, where you can get an initial impression of your situation and options for $250.00+HST, with no obligation past that meeting. If, after that initial consult, you decide you would like our help to pursue the issue, we bill dispute matters at an hourly rate. This is because some issues can be dealt with quickly through negotiation and settlement, while others can be drawn out in litigation, or anywhere in between.

Vacant land

If you are looking to purchase a piece of vacant land to build a home or cottage, we can assist you with the transaction. In addition to the regular aspects of a purchase, some additional things to consider when buying land with no home on it: Determine whether or not you will be allowed to install a well and septic, and where it will go. Make sure any easements you may need are properly recorded on the title. Likewise, it is important to know about any potential rights of way over the property prior to making your plans to build. We also recommend you have your building agreement reviewed by a lawyer prior to committing.  

private sale

If you are looking to purchase or sell a piece of land or vacation property, and you have not hired a real estate agent, we can help with the legal portion of your transaction. We can review your agreement of purchase and sale. We will review title to the property and alert you to any issues that may be a concern for a new buyers.
